Terms of service
The agreement between you and Gain Arcade for using the marketplace.
Not legal advice. These documents are drafted for this marketplace and are specific enough to review, but they have not been reviewed by a lawyer and they are not tailored to the countries you will actually operate in. Have counsel read them, and the review brief that ships with the repo, before you take a payment.
What Gain Arcade is
Gain Arcade is a marketplace. We connect buyers who want a service performed in a game with sellers who perform it, hold the payment held for the buyer while the work happens, and release it when the buyer confirms.
We are not a party to the service itself. We do not employ sellers, we do not supervise how they work, and we are not affiliated with, endorsed by or sponsored by any game publisher. Game names, logos and trademarks belong to their owners and are used here only to describe what a listing is for.
Where we act, we act as the sellers' limited payment collection agent: your payment to Gain Arcade discharges your payment obligation to the seller, and the seller must look to us, not to you, for their money.
Eligibility
You must be 18 or older to buy or sell. Sellers must complete identity verification before any payout, including legal name, date of birth and residential address, and must provide the tax documentation required in their jurisdiction.
We screen against applicable sanctions and politically-exposed-person lists and will decline or close accounts where we are legally required to. We do not serve users in jurisdictions we are prohibited from serving.
One person, one account. Accounts are not transferable and may not be sold.
The terms of service of other games
Account sharing and boosting breach the terms of service of most competitive games. Publishers may suspend, restrict or permanently ban accounts for it, and they may do so at any time, including long after an order is complete.
You accept that risk when you order a piloted service. No guarantee we or a seller makes changes what a publisher may do, and neither we nor the seller can restore a banned account.
Self-play and coaching services, where you play your own account, do not require you to share credentials and carry materially less risk. They are labelled as such on every listing.
Sellers must not use cheats, scripts, exploits, bot lobbies, account-generation tools or any third-party software that automates play. Doing so is grounds for immediate permanent removal, forfeiture of pending payouts, and return of escrow to affected buyers.
Payments, fees and escrow
Buyers pay the listed price plus a payment processing fee, both shown in full in the cart before checkout. Sellers pay a commission on completed orders only; the current rates are published on the fees page and may change on 30 days' notice for listings created after the change.
GainGuard is our buyer and seller protection. It holds the money safely until the work is done, and steps in if something goes wrong.
Funds are held until the buyer confirms delivery, three days pass after delivery without a response, or a dispute is resolved. Holding funds this way is a payment-processing arrangement, not a deposit account: it is not a bank account, it is not insured, it earns no interest for either party, and neither party may assign or borrow against it.
Payouts are made to a verified payout method after a clearing period. We support Payoneer, SEPA and international bank transfer, Wise, Skrill and PayPal; minimums and fees vary by method and are shown in full before you confirm a withdrawal.
We do not accept or pay out in cryptocurrency.
Disputes and refunds
Disputes must be opened through the order before it completes. We decide them on the record in the order chat and the order timeline, which is why communication has to stay on the platform. The refunds and disputes policy sets out how, and is part of these terms.
Opening a dispute freezes escrow in both directions until it is resolved.
Prohibited conduct
Taking or requesting payment outside Gain Arcade; sharing another person's account without their permission; buying or selling stolen accounts, credentials or codes; harassment; and any attempt to obtain another user's identity, address or payout details.
We may suspend accounts, freeze escrow and withhold payouts where we reasonably suspect fraud, money laundering or chargeback abuse, for as long as an investigation reasonably requires.

Chargebacks
If you dispute a card payment with your bank rather than with us, we will present the order record, chat, timeline, delivery evidence and any code reveal timestamps, to the card network.
A chargeback filed on an order that was delivered, where you did not first open a dispute here, may result in your account being closed and the balance held pending the network's decision.
Intellectual property
The Gain Arcade name, site and software are ours. Listing text, images and profile content are yours; you grant us a licence to display and promote them on the marketplace and in marketing for it.
You may not upload publisher artwork, copyrighted images or another seller's copy. The DMCA policy explains how to report infringement and how to counter-notify.
Suspension and termination
You can close your account at any time once no order is open. We can suspend or close an account for a breach of these terms, for a legal or risk reason, or where a payment provider requires it.
Closing an account does not cancel a completed order's obligations: escrow already held is resolved under the dispute policy, and payouts already earned are paid to a verified method.
Liability
To the extent permitted by law, our liability arising out of any order is limited to the amount paid for that order. We are not liable for the loss of a game account, in-game items, ranks, currency or progress, or for a publisher's decision to suspend an account.
Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
Changes, law and disputes with us
We will give notice of material changes to these terms. Continuing to use the marketplace after they take effect is acceptance.
Consumers keep the mandatory protections and the courts of their country of residence. Nothing here removes a right you have under the consumer law of the place you live.
